One filing covers the country

A single national register covers all of Australia. Applications are in English, and one application can cover multiple classes.

10-year term

Registration runs 10 years from the filing date and is renewable indefinitely, with a 6-month grace period after the renewal deadline.

6-month convention priority

Paris Convention priority can be claimed within 6 months of the first filing. Australia is also a Madrid Protocol member.

Examination in 3 to 4 months

IP Australia typically issues a first examination report, or accepts the application, within 3 to 4 months of filing.

15 months to respond

Applications must be accepted within 15 months of the first report, so there is generous room to respond, and extensions are available.

No use evidence at filing

Australia requires no evidence of use to file or register. An intention to use the mark is sufficient.

No formalities

No power of attorney, no notarisation, no legalisation. Written instructions by email are all we need to act.

Address for service

Every application needs an address for service in Australia or New Zealand. We provide ours the moment you instruct us.

IP Australia's official fees start at A$250 per class for an online application using the goods and services picklist, correct as at July 2026. Contact us for our schedule of charges for associates.

    Filed the same business day we receive instructions, with the application number and filing receipt returned to you immediately.

  2. 02

    Examination

    3 to 4 months

    IP Australia examines and either accepts the application or issues a first report. We review every report and recommend a course of action.

  3. 03

    Acceptance

    within 15 months of the first report

    Objections must be overcome within 15 months of the first report. Extensions and deferment are available where needed.

  4. 04

    Opposition window

    2 months

    Acceptance is advertised and third parties have 2 months to oppose. Most applications pass through unopposed.

  5. 05

    Registration

    from 7.5 months

    The earliest an Australian trade mark can register is about 7.5 months from filing. The 10-year term runs from the filing date.
